Review typical contract clauses encountered by Subcontractors and discuss the potential problems of such clauses to Subcontractors, concentrating on some of the more practical clausesin Subcontracts:

Patrick Ouellet is a Civil Engineer by trade that has worked in the construction industry and construction claims for over 25 years. He is Owner of a consulting firm that helps Contractors, Owners, Sureties, Claim Consultants and Legal Firms with all operational aspects of construction; from estimating and bidding, to contract review, documentation and change management, as well as project closeout and construction claims. He is also an adjunct instructor at Dunwoody College of Technology in Minneapolis, Minnesota
Jason Tarasek, Attorney with Thompson Tarasek Lee-O’Halloran PLLC
Default and termination
Jason Tarasek is a construction attorney who resolves disputes through negotiation and, when necessary, litigation. He is a member of the Board of Directors of the Minnesota Subcontractors Association. Jason assists subcontractors in obtaining full payment for their work. He often forecloses mechanic's liens on behalf of his clients, who - when successful - may be entitled to recover their attorney's fees. He has successfully first-chaired jury trials, bench trials and successfully argued cases to the Minnesota Court of Appeals and Minnesota Supreme Court. He represents clients throughout Minnesota and North Dakota.
